These Terms & Conditions govern your access to and use of the website, m-web and mobile application which is launching soon (collectively referred to as “Platform”) owned and operated by AAT Healthtech Private Limited (“Company”). By accessing the Platform, you are giving your full consent and agreement to these Terms. Your access to and use of the Platform and the services and products is conditioned on your acceptance of and compliance with these Terms. We request you to please read these Terms & Conditions carefully before using or registering on the Platform and its services and products. If you do not agree to the terms & conditions, kindly do not access the platform.
This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder, as applicable and amended from time to time, along with the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Please note that any and all content; information, material, tips and guidance or details, services and products available on the Platform (except such information sought from a Registered Medical Practitioner), is not intended to be of a diagnostic and prescriptive nature. And neither is it recommended to be used for self-treatment. These are intended to be informational and educational. Use of the platform does not in anyways become a substitute for professional medical advice, diagnosis or in person treatment by a qualified medical professional. And hence a complete reliance on any content provided by the platform is at your own risk.
Our Programs and Services are designed to explore and support your health & wellness choices, decisions and behaviours with respect to your overall lifestyle. These decisions and choices are yours, and please be cognizant that you are the best person to decide about your own health and wellness. Any decisions, choices or behaviours you make should be made in accordance with the advice you receive from your own doctor. We and everyone at Wellfinity.in or its representative are not liable or responsible for any injury or disease including aggravation, acceleration or recurrence of such injury or disease or death arising through the content, resources, services or products from the platform. The platform may recommend health supplements and nutraceuticals, but the use of such supplements and nutraceuticals is solely your decision. You should seek advice from your medical practitioner before consuming any such supplements. We have immense respect for every and all different medicine, science, treatment, protocols and also huge respect for mother nature and the healing power of the human body.
Our Services
Through our Platform, we provide, including but not limited to, the following services, to all our members subject to the terms and conditions provided in this document. Please do note that these will keep undergoing additions and or replacements and are indicative services.
Health and Wellness Programs & Packages
We provide various kinds of programs and subscriptions related to overall health, wellness, current imbalances and or conditions management. Depending on which program you select via the platform, there are different offerings and mandatory requirements (which may also include services undertaken through our third party partners) for each that need to be adhered to at different stages of the program.
As part of our services and offerings, the platform would hold your personal and medical records and monitor your current and past health and wellness that is essential for the effective working of the different lifestyle related programs and packages on the Platform.
Consultancy, Appointments & Tele / Digital-consultation
We provide appointments, tele / digital consultation services with our clinical and other experts or coaches who are engaged with Wellfinity.in, either directly or indirectly, through the Platform. These consultation services can be booked by you directly on our platform and or through other digital mediums that the company offers, however, are subject to the availability of such clinicians, experts or coaches. If you select to avail of the tele / digital consultation, please be aware that you are doing so on your own risk and that the details of the experts on the platform is not a guarantee of their services. Please be informed that the way these consultations work is that they take into view the medical records provided by you and if there are any errors or wrong representation or lack of information, it may lead to an inaccurate or incomplete guidance.
You may also cancel or reschedule your appointments as per cancellation section below and likewise the company may also request for reschedule accordingly. Any other such request outside the cancellation section shall not be obliged with.
Since the company offers a digital platform for these services, you can avail of the tele / digital consultation even if you are not residing in India. However, it is strongly recommended that any recommendation or guidance provided needs to be validated by practitioners in your country of current residence.
While accessing or registering or undertaking any program with us, you knowingly may provide us information that we receive and store. When you register on our platform you may share your (i) general personal information such as your name, username, email address, gender, birth date, height, location, photographs, profession and (ii) specific health and wellness related personal information about yourself that will be useful for the success of the program and your overall wellness. You can choose not to provide us with certain information, but then you may not be able to register with us or for us to effectively plan your personalized program and achieve success at the end of program. It is our endeavor to anonymize and protect your PI so that you cannot be individually identified to the extent and situation it is possible.
Please be advised to consider these factors before engaging the services accordingly.
Diagnostic & Testing services
A significant part of the Wellfinity.in works is to understand the root cause of your problems, conditions and or imbalances. Towards this aspect a key part is diagnostic services which can be availed of by booking appointments on the Platform. Our diagnostics services are facilitated by accredited third party partners through the platform. The reports will be made available within the specified time period at the time of booking and shall be shared only in electronic form and shall be sent to your registered email address on the platform. Do kindly note that we may disclose information or provide reports to family members if required under applicable laws. Through this Terms & Conditions and the Privacy policy, you hereby provide your full consent to share your personal data that may be required for providing such diagnostic & testing services.
Structured educational content; blogs, videos, posts, recipes, podcast, infographic, etc.
Through the programs and packages we offer and provide you a varied set of structured educational content on health and wellness on our platform. These are well researched and written by professional, but they merely the serve the purpose as informational and educative and should not be construed as an advice in any way.
Cancellation & Refund Policy
The platform offers genuine care to all its user including you. However, if you have to cancel consultations, programs or packages, such cancellation shall be governed by the timelines mentioned on the Platform before signing up for any such services. We would not be able to offer you any refunds if such cancellation is done after the specified period mentioned on the platform.
Rescheduling of consultations is very much possible, however, it shall be governed by the timelines mentioned on the platform and also subject to availability of the new day / time slots.
In case of any special emergencies, like covid or having met with a serious injury or hospitalisation, the platform has the right to offer you a pause to your existing program, packages or services and recontinue based on case to case basis.
Payments for any services availed through the platform or otherwise, shall be collected in advance on the Platform or otherwise. The applicable taxes or any third-party charges may apply towards such payments which is not included in the service amount mentioned on the platform. Whensoever there is a cancellation by you, the amount that is to be refunded will be refunded to the source account from which the payment was made by you
and the same shall be initiated for refund within five (5) business days from the date of such request of refund. Timelines for refund of the designated amount to the source account shall be governed as per the relevant payment gateway and bank’s policy.
Use of Platform
You hereby agree, acknowledge and give full consent that you are accessing the Platform, at your own free will, risk, choice and initiative. You further agree and undertake to ensure that such use of the Platform by you complies with the Terms & Conditions captured in this document along with compliance to all applicable laws, regulation and or court order, including the local laws of the places where you access the Platform from, either temporarily or permanently.
Communications, Notifications, Messages, Emailers
Our services are highly informative and continues to serve your purpose even after you may have successfully completed a particular program or service. Towards this regard we send out informative communication at set intervals and on an ad-hoc basis by way of SMS, e-mails, notifications or any other electronic medium and you hereby expressly agree to receive all such communications through the Platform. You can willingly unsubscribe / opt-out from receiving such communications by visiting the Platform.
Intellectual Property Rights
The Platform and the processes, and its selection and arrangement, including but not limited to, all the materials, text, images, videos, graphics, trademarks, logos, button icons, sounds and music, software and its elements is owned and the property of AAT Healthtech Private Limited or its licensors and are protected by copyright, patent and trademark laws, and various other intellectual property rights.
The trademarks, logos and service marks displayed on the Platform are registered trademarks and the sole property of AAT Healthtech Private Limited and / or other respective third parties. Without the prior consent of AAT Healthtech Private Limited, one is not permitted to use them in any manner whatsoever.
Disclaimer of Warranty & Liability
You acknowledge and agree that your access to and use of the platform is at your own risk. The platform and its services, content, information and any other aspects is provided to you on an “AS IS” and “AS AVAILABLE” basis without warranty of any kind, express, implied, statutory or otherwise, representation and/or guarantee and you are in complete awareness and agreement to the same.
Wellfinity.in hereby disclaims all liability pertaining to any and every of its services offered through its platform. Further, it does not guarantee any specific result, outcome or end goal through any of its services and that you accept the risk that results might differ for each user. You are very much aware that the success of such programs depends very much on each user’s personal background, and other related factors. Your results may vary from other users on and off the platform, and is based on multiple variables and moving elements.
The platform genuinely wants you to get the best from it and hence in its constant endeavor strives to ensure the quality of services, content and information and any other aspects is correct and will meet your expectations. However, the platform neither warrants nor makes any representations regarding the quality, veracity, accuracy or completeness of any data, information or content. Wellfinity.in shall not in any manner be responsible for any delays or the inability to use the Platform or related functionalities. Even during the times when the platform is undergoing period maintenance and hence the non-availability or any unplanned lack of access to the Platform due to technical or for that matter any reasons control. Further, Wellfinity.in shall not be liable for any loss due to unauthorized access and use of your account or its pertaining information, either with your knowledge or without it. Any kind of download or any access to information in connection with your hardware is done at your own free will and risk with a clear understanding and knowledge that any damage to your hardware be it computer, laptop, phone or loss of any data in connection to using the platform is solely your responsibility and ownership.
Limitation of Liability
To the maximum extent permitted by applicable law, Wellfinity.in shall not be liable for any indirect, incidental, special, consequential or punitive damages or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses resulting from Your access to or use of or inability to access or use of the Platform.
Violation of Terms & Conditions
By using this platform, you agree that any violation of any of these Terms will constitute an unlawful and unfair business practice, and will cause irreparable harm to us and/or our partners, for which monetary damages would be inadequate. Further, you consent to Wellfinity.in obtaining any injunctive or equitable relief that they deem necessary or appropriate in such circumstances. These remedies are in addition to any other remedies that Wellfinity.in may have at law or in equity. Any legal action taken against you as a result of your violation of these Terms, Wellfinity.in will be entitled to recover from you, and that you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief that may be granted.
Report Abuse and Grievance Redressal
If at any point of time you come across any abuse, objectionable content or violation of these Terms or you wish to report a grievance or file any complaint regarding the platform, please address them to [email protected]. Your grievance and or complaint will be duly looked into and addressed.
General Terms
Notice: All notices from AAT Healthtech Private Limited will be sent to your registered email address by email or via a general notification on the platform. Any notice pertaining to the Terms & Conditions should be sent to [email protected] mentioned Terms & Condition in the subject.
Assignment: You cannot assign or otherwise transfer the Terms, or any rights granted hereunder to any third party. AAT Healthtech Private Limited’s rights are freely transferable to any third party wherein there is no requirement to seek your consent.
Severability: If, for any reason, a court of competent jurisdiction finds any provision of the AAT Healthtech Private Limited Terms, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect.
Waiver: The failure of the Company to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
Governing Law and Jurisdiction
These Terms & Conditions shall be governed and structured by the laws of India. In the case of any dispute in relation to these Terms, the courts in Bengaluru, Karnata shall have exclusive jurisdiction.
Entire Agreement
These Terms and Conditions and Privacy Policy or any other policies or operating rules listed by us constitutes the entire and exclusive agreement and understanding between you and the company and governs your use of the service regarding the platform, and that these terms & conditions supersede any replace any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and the company.
